1.1. The organizer of the promotion is Mobizon LLC, EDRPOU code 37623364, Bila Tserkva, Petra Zaporozhtsa Street, building 195, apartment 51 (hereinafter referred to as the Organizer).
1.2. The promotion is held to popularize the services provided by Mobizon LLC and to draw the attention of TurboSMS service clients to new offers, promotional campaigns, etc.
1.3. The Organizer is not responsible for the participant's failure to familiarize themselves with these Rules.
2.1. To participate in the promotion, the following steps must be completed:
2.2. Failure to comply with the promotion conditions outlined in clause 2.1. of the Rules during the promotion period deprives the person of the right to participate in the promotion and claim a prize.
3.1. Participants of the promotion are recognized as TurboSMS service clients who are already registered with TurboSMS or register during the promotion and who properly comply with the requirements of the Rules of the promotion (hereinafter referred to as Participants).
3.2. Minors, incapacitated persons, employees of the Organizer, and affiliated persons are not recognized as Participants and cannot participate. Persons with limited capacity can participate exclusively through their legal representatives in accordance with the current legislation of Ukraine.
4.1. The promotion is held throughout Ukraine.
5.1. Registration of participants is conducted from 22.09.2014 to 30.09.2014 (inclusive) on the website http://turbosms.ua.
5.2. To participate in the promotion during the period from 22.09.2014 to 30.09.2014 inclusive:
6.1. Under the terms of the promotion, participants are provided with the opportunity to receive 123 TurboSMS service credits as a gift (hereinafter referred to as the Prize). The Organizer reserves the right to replace the Prize with another of the same level at its discretion.
7.1. The participant is responsible for promptly informing the Organizer of changes in address, phone number, and other personal data.
7.2. Participants who have acquired the right to receive prizes cannot receive their cash equivalent. In case the participant refuses the prize obtained under this promotion, the participant has no right to claim any compensation from the Organizer.
7.3. By participating in the promotion, the participant fully agrees to these Rules and undertakes to comply with them. Violation of these Rules by the participant or refusal to comply with them automatically deprives them of the right to receive the prize.
8.1. Participants who are entitled to receive the Prize can receive it exclusively by crediting it to their personal electronic virtual account in the TurboSMS service.
8.2. The prize is credited after the review submitted by the participant is verified (moderated) and published on the TurboSMS website. The Organizer reserves the right to make grammatical and stylistic corrections to the reviews submitted by the participant and to determine, at its discretion, which reviews will be published on the TurboSMS service website.
9.1. By participating in the promotion, each participant confirms their consent to the use of the reviews provided by them and information about themselves or the company they represent by the Organizer for marketing and/or any other purpose, in ways that do not violate the current legislation of Ukraine (including transfer to third parties), particularly for the free use of their name, surname, image of the participant, interviews, or other materials about them for advertising/marketing purposes, including publication rights (including their name and image) in mass media, any printed, audio, and video materials, interviews with media, dissemination of information, messages (including advertising messages), etc., without any restrictions on territory, time, and method of use, and such use will not be compensated by the Organizer and/or any third party. This consent is understood within the meaning of Articles 296, 307, 308 of the Civil Code of Ukraine and the Law of Ukraine "On Personal Data Protection."
9.2. By participating in the promotion, each participant confirms that they have all the necessary authority to use and disseminate any information about the participant and assumes responsibility for the information provided by them. The Organizer is not responsible for the unlawful dissemination and/or use of the information about the participant. The Organizer reserves the right to send an information request to the participant to establish their identity with registration data.
9.3. By participating in the promotion, each participant confirms that they are aware of their rights regarding personal data and confirms that the Organizer and other third parties engaged by the Organizer to prepare and conduct the promotion are exempted from the obligation to send the participant written notifications about the rights, purposes of data collection, and persons to whom their personal data is transferred.
9.4. The Organizer is not responsible for fulfilling its obligations under the promotion in case of circumstances beyond its control caused by force majeure events that the Organizer could not influence, namely natural disasters, fires, floods, military actions of any kind, blockades, significant changes in legislation effective in the promotion territory, and other circumstances.
9.5. The participant's inability to collect prizes under the conditions specified in the Rules for any reason beyond the Organizer's control is equated to the participant's refusal of the prizes and does not entail any responsibility of the Organizer for the non-delivery of prizes.
9.6. In case of a situation allowing ambiguous interpretation of these Rules, any disputed issues, and/or issues not regulated by these Rules, the final decision on such issues rests with the Organizer. The Organizer's decision is final and not subject to appeal.
9.7. The Organizer may change and/or supplement these Rules throughout the promotion period, and information about the terms and conditions of the promotion is posted on the website https://turbosms.ua.
